How long does it take to get a response to an appeal?

An appellate court can issue its opinion or decision in as little as a month or in a year or more. The average time period is 6 months, but there is no time limit. The deadline does not indicate the type of decision the court will take. In general, you must file an appeal within 30 days of the date of the decision (not the date you received the decision).A shorter appeal period may apply in some cases, such as revoking the approval of a petition, which has a deadline of 15 days.

Your decision will tell you how much time you have to file the appeal. There is no extension to this deadline. However, an additional 3 days are granted when your decision is mailed to you (33 days in case of denial and 18 days in case of revocation)). It took about 4 to 5 months.

You must have sent or delivered a copy of your appeal to the agency responsible for the subpoena and you must prove under oath that you did. If you are the beneficiary of a petition, you currently have an approved Form I-140 for which the USCIS has issued a notification of intent to revoke and you meet the last three criteria listed above, you can submit evidence in response to that notification of intent to revocation.
